Do you need a guardianship attorney?

A guardianship is used when a minor’s parents are not available to protect the minor. If a minor receives assets (for example, money, real property, or stocks) in the minor’s own name, a guardian of the assets is appointed to handle the minor’s financial affairs. A minor cannot enter into a contract in California and it is not a good idea to put young children in charge of managing large sums of money.

A guardian of the estate must file an inventory and appraisal of the assets belonging to the minor and must file a periodic accounting with the court.

This is different from guardianships over adults, which in California are called “conservatorships.”
