What is Community property?
California is a community property state. That means that anything earned or acquired during marriage except by gift or inheritance is community property. That includes your pension, IRA, and may include the future earning potential, for example, of a doctor whose wife helped put him through medical school. Both spouses have an equal and undivided interest in the community property. So in a divorce, all the community property is divided into two halves.
What is Separate Property?
Separate property is anything the spouses had before they got married and any gifts or inheritances they got during marriage. In a dissolution, each spouse gets to keep his or her separate property. If separate property is commingled with community property, it may become community because it was put into the community pot.
